2026 governmental net-zero policy restrictions

Section 1 creates Fla. Stat. § 377.816. It prohibits a governmental entity from enacting or enforcing a policy that supports a defined net zero policy; using public funds for specified procurement preferences or payments to private organizations conditioned on such policies; imposing specified charges; or establishing specified emissions caps, trading programs, or incentives. Subsection (7) preserves governance by boards of municipalities or entities that own or directly control a utility, Public Service Commission authority, and otherwise-lawful energy and pollution-control authority. The section applies to proposed governmental action on or after July 1, 2026 that is not otherwise permissible under general law.
